Attorney General Jackley joining SDAHO in nationwide lawsuit against CMS [Video]

RAPID CITY, S.D. (KOTA) – South Dakota Attorney General Marty Jackley and the South Dakota Healthcare Organizations are taking a stand against a nursing home staffing mandate.

SDHAO and Jackley are joining a nationwide lawsuit with other organizations and 20 other attorneys general to challenge federal nursing home staffing requirements proposed by the Centers for Medicare and Medicaid Services.

The staffing mandate requires nursing homes to have a staffed registered nurse 24 hours a day.

Jackley says we are seeing unfunded federal mandates, especially in rural America.

He added there is no ability for nursing homes or the state to necessarily pay for some of the staffing requirements.

”While well-intended, they’re not paid for and therefore, we’re concerned that it will ultimately cost a shutdown or breakdown of some of our nursing facilities or cause cost-cutting measures in other needed areas for those nursing homes,” Jackley said.
